These Terms and Conditions of Use, as well as any other legal document incorporated by reference (hereinafter, the "Conditions"), establish the legal agreement between Talentato (hereinafter, "Talentato", "the Company", "we" or "us") and any person who accesses or uses our website, digital platforms or services (hereinafter, the "User").
These Conditions govern access to and use of all of Talentato's digital properties, including but not limited to the official website, online platforms, contact forms, informational materials, digital content, tools, methodologies, as well as any other service offered by Talentato related to human resources consulting, talent recruitment and selection, professional guidance and associated services (together, the "Service").
Use of the Service involves access to information, content, proprietary materials, digital tools and specialized services provided by Talentato, either directly or through authorized third parties.
READ THESE CONDITIONS CAREFULLY BEFORE USING THE SERVICE, AS THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS. By accessing, browsing or using the Service, the User acknowledges having read, understood and accepted to be bound by these Conditions. If they do not agree, or if at any time the Conditions cease to be acceptable to the User, they must refrain from using the Service and stop using it immediately.

Regarding cancellations:

Dispute resolution
Any dispute arising from the use of the Service or from these Conditions will be resolved in accordance with the applicable legislation in Mexico.
As far as possible, the parties will seek to resolve any conflict amicably before turning to legal proceedings.
Intellectual property
All the content available in the Service, including texts, materials, methodologies, designs, trademarks, logos, videos and tools, is the property of Talentato.
The following is strictly prohibited:
- Copying, reproducing or distributing content without authorization

To the extent permitted by applicable law, Talentato provides the Service "as is" and does not guarantee specific results, including but not limited to:

Limitation of liability
To the extent permitted by law, Talentato will not be liable for:
- Hiring decisions made by third parties
- Results derived from the use of the Service
- Indirect damages or economic losses

FULL CONDITIONS OF USE – TALENTATO
- Acceptance and contractual relationship
By accessing, browsing and/or using Talentato's website, as well as any of the services offered through it (hereinafter, the "Service"), the User expressly declares that they have sufficient legal capacity to be bound by these Conditions, in accordance with applicable law.
If the User does not have such legal capacity, they must refrain from using the Service at any time.
Use of the Service implies full, express and unreserved acceptance of these Conditions of Use, as well as of any other legal document, policy or guideline that forms part of it, including the Privacy Notice. These Conditions constitute a binding agreement between the User and Talentato.
- Privacy
Protecting the User's personal data is a priority for Talentato.
All personal information provided by the User through the site will be processed in accordance with the Privacy Notice, which is an integral part of these Conditions and is available for consultation on the website.
Talentato may collect, use, store and, where applicable, transfer the User's personal information for the following purposes:
- Establish communication with candidates and companies
- Provide recruitment, selection and consulting services
- Follow up on hiring or guidance processes
- Generate internal statistics and improve the quality of the services
The User acknowledges and accepts the processing of their data as described above.
- Changes to the Conditions and to the Service
Talentato reserves the right to modify, update or remove, at any time and without prior notice, these Conditions, as well as any functionality, content or feature of the Service.
The modifications will take effect once they are published on the website.
The User's continued use of the Service after such modifications are published will constitute tacit acceptance of them. If the User does not agree, they must immediately stop using the Service.
- Use of the Service
The User undertakes to use the Service responsibly, lawfully and in accordance with these Conditions.
By way of example and without limitation, the following is prohibited:
- Using the Service for unlawful purposes or purposes contrary to applicable law
- Providing false, inaccurate or misleading information
- Interfering with, damaging or affecting the operation of the site or its systems
- Attempting to access databases, servers or related systems without authorization
- Using the Service to harm third parties
Failure to comply with the above may result in the suspension or cancellation of access to the Service.
- Services offered
Talentato offers specialized services in human resources and talent management, including by way of example:
For companies:
- Talent recruitment and selection services
- Technical, professional and cultural evaluation of candidates
- Guidance on hiring processes and organizational structure
For candidates:
- Professional positioning guidance
- Profile optimization (CV, LinkedIn, interviews)
- Access to digital training content (videos, guides and tools)
The specific features of each service may vary and will be communicated in each case.
- Nature of the service
Talentato does not guarantee obtaining a job, interviews, job offers or specific results derived from the use of the Service.
The User acknowledges and accepts that:
- Talentato acts exclusively as an intermediary and advisor
- It does not guarantee that candidates will be hired or that a job will be obtained
- It does not guarantee specific results in recruitment or guidance processes
- There is no employment relationship between Talentato and the candidates or users
- Final hiring decisions rest exclusively with the companies, under their own responsibility.
Likewise, Talentato does not act as an employer, formal placement agency or legal representative of any of the parties. Any employment or contractual relationship generated will be the exclusive responsibility of the parties involved.
- Registration and accounts
To access certain services, the User may provide personal information or register on the site.
The User agrees to:
- Provide truthful, complete and up-to-date information
- Keep their access credentials confidential
- Be responsible for all activities carried out under their account
Talentato reserves the right to suspend or cancel accounts when it detects misuse, false information or a breach of these Conditions.
- Payments and services
By contracting any service offered by Talentato, the User accepts the commercial conditions, prices, scope and payment methods previously communicated.
The services may involve:
- One-time payments or recurring payments, depending on the type of service contracted
- Invoicing in accordance with applicable tax legislation
Talentato reserves the right to modify the prices of its services at any time. However, such changes will not affect services already contracted, unless they are renewals or recurring services, in which case the User will be notified in due time.
Payment processing may be carried out through authorized external providers, so the User also agrees to be bound by the terms and conditions of those third parties where applicable.
The User undertakes to:
- Provide valid, complete and up-to-date payment information
- Make the corresponding payments on time
- Assume any tax, bank fee or additional applicable charge
Failure to make payments may result in the suspension or cancellation of the contracted services, with no liability for Talentato.
In the event of non-payment, Talentato may suspend access to the Service with no obligation to reactivate it until the situation is resolved.
- Cancellations and refunds
The specific cancellation and refund conditions will depend on the type of service contracted and will be communicated to the User before hiring.
In general:
- Cancellation requests must be made through Talentato's official channels
- Once the service has started, no refunds will be granted, unless otherwise required by law or expressly agreed in writing
- For services contracted by period (monthly or other), access may be maintained until the end of the period already paid for, with no automatic renewal in the event of cancellation
If the User does not use all or part of the contracted service, this will not give rise to any right to a refund.
Any exception to the above must be expressly stated in writing and authorized by Talentato.
- User Content
The User may provide information such as:
- Curriculum vitae
- Professional data
- Testimonials or comments
The User warrants that such information:
- It is truthful, current and complete
- It does not infringe third-party rights
By providing content, the User authorizes Talentato to use it for operational, evaluation and service improvement purposes and, where applicable, for commercial or promotional purposes, always in compliance with applicable regulations.
- Intellectual property
All the contents of the site, including but not limited to:
- Texts
- Design
- Methodologies
- Materials
- Videos
- Logos and trademarks
are the property of Talentato or its licensors.
It is strictly prohibited to reproduce, copy, distribute or use such content without prior written authorization.
Unauthorized use of the content may give rise to the corresponding legal action.
- Limitation of liability
To the fullest extent permitted by law, Talentato will not be liable for:
- Hiring decisions made by third parties
- Results obtained by users
- Actions or omissions of candidates or companies
- Indirect damages, loss of income or opportunities
The Service is provided "as is", with no guarantee of specific results.
- Relationship between users
Talentato acts solely as an intermediary between companies and candidates.
Any employment, contractual or commercial relationship that arises between such users will be independent of Talentato, which will not be responsible for the obligations arising from those relationships.
- Third-party sites
The site may contain links to third-party websites.
Talentato is not responsible for:
- The content of those sites
- Their privacy policies
- The use of information provided on them
Access to external sites is at the User's own responsibility.
- Termination of the service
Termination of the Service does not release the User from fulfilling outstanding payment obligations. Talentato may, at any time and without prior notice:
- Suspend or cancel access to the Service
- Delete accounts
- Restrict functionality
in the event of a breach of these Conditions or misuse of the Service.
- Applicable law
These Conditions shall be governed by and interpreted in accordance with the laws of the United Mexican States.
17. Confidentiality
The User undertakes to maintain the confidentiality of any information they access through the Service, including information about candidates, companies, processes, methodologies or any other data considered sensitive or strategic.
Such information may not be disclosed, reproduced or used for purposes other than those established in the Service without prior written authorization from Talentato.
18. Force majeure
Talentato will not be liable for breaches or delays arising from causes beyond its reasonable control, including but not limited to technical failures, service interruptions, natural events, labor disputes or third-party failures.
